TERMS AND CONDITIONS
Launching at any time requires the account to be paid in full and all checks cleared. All invoices are due when billed. One and one- half percent (1 ½%) interest per month on the unpaid balance will be added to all accounts over thirty (30) days past due, and the owner agrees to pay all costs of collection of overdue accounts including reasonable attorney’s fees.
Payments and deposits are non-refundable.
Slip assignments are at the discretion of CBY. Slips are not transferable and are not to be swapped, subleased or advertised without written permission of the yard.
WORK ON BOATS: Owners may work on their own boats when docked or stored at CBY, but it is agreed that all associated services will be procured through CBY. If outside labor is permitted, an acceptable certificate of insurance must first be filed in CBY office, and CBY will be due reasonable fees and expenses for use of facilities. Outside Subcontractors are allowed in our yard with the following requirements:
All subcontractors must check in with the office before performing any work.
All subcontractors must have a certificate of insurance filed with the office before performing any work.
If the subcontractor does not bill thru us, a separate 15% subcontractor fee will be applied to your account based on the subcontractor’s invoice. If an invoice is not provided, the 15% fee will be based on our estimate of the job, or a minimum of $150.
Outside Subcontractors are NOT allowed to shrink-wrap anything stored at Crocker’s Boatyard.
GENERAL RULES:
~When boat is launched that does not have summer dockage here, three- (3) day’s dockage will be provided without charge.
~All owners must keep area around boat clean and free of any rubbish.
~No fires on docks. Grills, etc. may be used with proper safety precautions ashore.
~If ownership of boat changes, all bills if any, shall be paid in full before boat leaves CBY.
~Summer season is May 1 to November 1, after which utilities will be shut off on docks. Boats in water after December 1 will be hauled, winterized, and stored at CBY rates at owner’s expense unless other arrangements have been made with CBY.
~Heads are to be sealed when at dock; please use shore facilities, pump out and portable toilet dump station; this is a CT State Law.
~All hazardous wastes, acetone, paint thinner, gas, diesel, waste oil, paint cans, brushes and rollers, cannot be disposed of in the trash cans or trash dumpster at CBY. Hazardous wastes must be put in an approved container for vessel owner to be removed and disposed of off site. See yard manager for assistance.
~No heaters are to be used when no one is aboard. No cords plugged in on land when no one is aboard.
~No smoking at any time in sheds.
~Dock boxes are prohibited on docks.
~Only approved dock bumpers can be fastened to the docks.
~Parents or guardians are responsible for their children at all times at CBY, in yard, on docks and in pool area.
~Borrowing of tools from CBY or employees is prohibited.
~No winter storage covers are to be tied to boat stands or boat supports.
~No blocks, boat supports, or stands are to be moved or adjusted except by CBY.
RESPONSIBILITY: The grant of any storage space and launching service, mooring, slip, or dock space, tie-up privilege, towing, hauling, or moving afloat or ashore, or any service whatsoever granted by CBY shall be accepted with the distinct understanding, and the owner agrees, that neither CBY nor any of its owners, directors, officers, employees, or agents assume any responsibility whatsoever for the safety of any boat at the CBY, either ashore or moored in the boat basin or adjoining waters or during launching, hauling or lifting operations and none of them shall be liable to the owner or any person claiming by, through or under him for fire, theft, or any damage or loss of use whatsoever to any such boat and its equipment, or to any property or the person of the owner, his family, employees, guests, or invitees, however caused.
In addition, owner does hereby indemnify and hold harmless CBY and its owners, directors, officers, employees, and agents of and from any and all liability, claims and demand for damage to the property of an injuries to, or other property damage and personal injuries caused by, the owner, his family, employees, guests or invitees.
The owner agrees that any grant of storage and launching service shall constitute a rental of space only and no bailment of any kind is intended or created either express or implied. The owner further agrees that all risk of loss, damage, or destruction of said vessel, its equipment or other property of the owner shall at all times be borne by the owner.
All boats must have hull and liability insurance, and owners must provide CBY with certificate of insurance. No terms or conditions herein may be changed or modified unless in writing, signed by the parties hereto. Any violation of the terms and conditions of the Agreement or posted regulations of CBY shall give CBY the option of terminating this Agreement upon ten (10) days written notice to the owner, during which ten days the boat must be removed from the marina. All pricing reflects a 3% cash/check discount. A 3% increase will be incured if payment is made via credit card.
